The owner of the online store nola.ee (hereinafter the online store) is Nola OÜ (registry code 14829357), located at Veski tn 9, Kuressaare, Saaremaa vald, Estonia.
Validity of contract of sale, product and price information
The terms of sale apply to the purchase of goods from the online store. Nola OÜ is the controller of personal data and transmits personal data which are necessary for making payments to the processor Maksekeskus AS. The prices of the products sold in the online store are indicated next to the products. All prices in the store are displayed in euros and payment in other currencies is not possible. Indicated prices do not include delivery fees. The amount of the delivery fee depends on the buyer’s location and the method of delivery. The amount of the delivery fee is shown during order finalisation. Information about the goods is displayed directly next to the goods in the online store.
To order goods from the online store, add the desired products to your shopping cart. To finalise the order, fill in the required information fields, ensure that they are correct, and select a suitable delivery method. After this, you will be shown the total price, which can be paid via a bank link provided by Maksekeskus. The sales contract shall enter into force from the receipt of the amount payable in the bank account of the online store. If the ordered goods cannot be delivered due to being out of stock or for any other reason, the buyer shall be notified at the earliest opportunity and the received payment (including delivery costs) shall be returned to the buyer as soon as possible, but no later than within 14 days from sending the notice.
The goods are shipped to all Member States of the European Union. The goods are delivered by Ominva or Itella Smartpost. Delivery costs shall be borne by the buyer and are indicated next to the delivery method. Shipments within Estonia are generally delivered to the location specified by the buyer within 3-7 business days from the entry into force of the contract of sale. Shipments outside Estonia are delivered within 14 calendar days. In exceptional cases, the goods may be delivered within up to 45 calendar days.
Right of withdrawal
After receiving the order, the buyer has the right to withdraw from the contract entered into in the online store within 14 days (depending on the products, the buyer may not have the right of withdrawal; in such a case, these products and services shall be listed and be in accordance with subsection 53(4) of the Law of Obligations Act.) The right of withdrawal does not apply to legal persons. In order to be eligible to use the 14-day right of withdrawal, the ordered goods must not be used in any manner other than that which is necessary to establish the nature, characteristics and function of the goods, similarly to what is allowed for testing the goods at a physical store. If the goods have been used for purposes other than those necessary to establish the nature, characteristics and function of the goods, or if they have signs of use or wear, the online store has the right to reduce the amount refunded by the diminished value of the goods.
In order to return the goods, a request for withdrawal must be sent to the e-mail address firstname.lastname@example.org no later than within 14 days of receipt of the goods.
The cost of returning the goods shall be borne by the buyer, except if the reason for the return is that the returned goods do not correspond to the order (e.g., wrong or defective item). The buyer must return the goods within 14 days after the submission of the application, or provide proof that they have transferred the goods to the carrier within this period. Upon receipt of the returned goods, the online store shall return to the buyer immediately, but no later than within 14 days from the receipt of the application for withdrawal, all payments received from the buyer under the contract. The online store has the right to refuse to refund the buyer until the goods which are the object of the contract have been returned or until the buyer has provided proof that they have sent the goods back, whichever is the earliest. If the buyer has expressly opted for a delivery method other than the least expensive standard delivery method offered by the online store, the online store shall not be required to reimburse the buyer for the costs which exceed the costs relating to the standard delivery method. The online store has the right to withdraw from the sales transaction and require the buyer to return the goods, if the price of the goods was marked significantly below the market value of the goods due to an error.
Right to file a complaint
The online store shall be liable for any lack of conformity or deficiency of goods sold to the buyer which existed before the delivery of the goods and which becomes apparent within 2 (two) years as of the date of delivery of the goods to the buyer. Therein, it shall be presumed that any deficiency which becomes apparent within 6 (six) months as of the date of delivery of the goods to the buyer already existed before the delivery of the goods. The rebuttal of this presumption shall be the duty of the online store. The online store shall not be liable for defects that have arisen after the delivery of the goods to the buyer.
If goods bought from the online store have defects for which the online store is liable, the online store shall repair or replace the defective goods. If the goods cannot be repaired or replaced, the online store shall refund the buyer for all costs incurred under the sales contract. The online store shall reply to consumer complaints in writing or in a format which can be reproduced in writing within 15 days.
Direct marketing and processing of personal data
The online store shall only use the personal data submitted by the buyer (including name, phone number, address, e-mail address, bank details) for processing the order and delivering the goods to the buyer. In order to have the goods delivered to the buyer, the online store needs to transmit the personal data to the delivery service provider.
Settlement of disputes
Complaints concerning the online store may be submitted by e-mail to firstname.lastname@example.org or by phone at +372 5624 4309. If the buyer and the online store are unable to settle the dispute by agreement, the buyer may contact the Consumer Disputes Committee. The terms for the procedures can be found and applications can be submitted here. The Consumer Disputes Committee has jurisdiction to settle any disputes arising from contracts concluded between a buyer and the online store. Buyer complaints are reviewed by the Committee free of charge. Buyers may also turn to the consumer dispute resolution platform of the European Union.
